NO SHOW NO REFUND AND OTHER TERMS AND CONDITIONS

READ THE FOLLOWING WAIVER AND RELEASE OF LIABILITY CAREFULLY FOR TRIPS/ACTIVITIES THAT YOU ARE BOOKING/ENROLLING FOR YOURSELF, YOUR TEENAGE CHILDREN, YOUR ADOLESCENT CHILDREN, AND/OR OTHERS KNOWN TO YOU.
BY PROCEEDING AND CONFIRMING YOUR BOOKING OF A TRIP AND/OR ENROLLING IN AN ACTIVITY ORGANIZED AND FACILITATED BY NAC SKI, LLC YOU HEREBY AGREE WITH THE TERMS AND CONDITIONS SET FORTH HEREIN AND YOU AGREE TO INDEMNIFY AND HOLD NAC SKI, LLC, ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, AGENTS, EMPLOYEES, VOLUNTEER WORKERS HARMLESS FROM ANY CLAIM OR DEMAND AND AGREE TO NOT FILE ANY LAWSUIT AGAINST NAC SKI, LLC AND ITS AFFILIATES, EMPLOYEES, AGENTS, AND VOLUTEERS. FORTHERMORE YOU EXPRESSLY UNDERSTAND AND AGREE THAT NAC SKI, LLC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, INJURY, LOSS OF PERSONAL ITEMS DURING SKIING, SNOWBOARDING, TRANSPORTATION OR LODGING, AND LOSS OF PAY DUE TO INJURY, TRAVEL DELAYS, TRIP CANCELLATION AND DISMISSAL FROM TRANSPORTATION DUE TO INAPPROPRIATE BEHAVIOR.
NOW THEREFORE by booking a trip or enrolling in an activity organized or facilitated by NAC Ski, LLC you affirm that, if you are booking/enrolling the trip and/or activity for yourself that you are 18 years of age or older and if booking for teenage children or adolescent children that you are the parent or legal guardian of all members of your party for which you have booked a trip. If you are not the parent or legal guardian, then you must print the
Parental Consent and have the parent or legal guardian sign and date the document, scan and email it to parentalconsent@nacski.com. Children under the age of 12 must be accompanied by a family member or person known to them who is age 18 or older. If you are booking/enrolling the trip and/or activity for the others, they must be your immediate family.
Non-family members in the same party must book individually on their own.
This WAIVER, RELEASE & INDEMNITY AGREEMENT is valid for any and all trips/activities that you book/enroll for yourself, your children, your immediate family members. This waiver and release of liability shall apply to the trip/activity being booked and all future trips booked/activities enrolled for the current season for up to 180 days of this current trip/activity being booked/enrolled.
ACKNOWLEDGEMENT, WAIVER, AND FULL RELEASE OF LIABILITY FOR YOURSELF AND ANY AND ALL PERSONS FOR WHICH YOU ARE BOOKING THIS TRIP AND/OR ENROLLING INTO AN ACTIVITY
Definition I/we acknowledge that the trip being booked involves a combination of transportation and physical outdoor sports activity.
Communication I/we acknowledge that the email address and mobile number and carrier information listed in my NAC SKI account profile are accurate and current. In the event of trip plan change such as cancellation, change of pickup location, change of pickup time, change of trip date and change of destination resort, NAC SKI may not make individual phone call, NAC SKI may choose to notify passengers only by email and/or text message to their mobile phones. It’s my responsibility to ensure timely checking and receiving of all emails and the text messages on my mobile phone.
Trip Cancellation I/We acknowledge that paying the any trip, early booking or confirmed, carries the risky of trip being canceled due various reasons. In such event, NAC SKI will issue full refund to all the paid passengers within 6 hours of such decision. I/WE will not hold NAC SKI responsible for any cost incurred due to the travel plan change caused by the trip cancellation beyond the refund of my original trip booking.
Individual Cancellation & Fees Individual cancellation requests must be filed on the web site under My account | Order History page ( not by email, not by voice message, nor "Contact us | File new case" ) at least 36 hours prior to the trip departure time. NAC SKI may, at its sole discretion, approve or deny individual cancellation request. Once a cancellation request is approved, NAC SKI will refund the original payment minus the handling charge of $15 per seat. If the cancellation does not involve bus seat, the handling charge will be $5 per resort product.
Cancellation Window Closes 36 Hours Prior Cancellation, re-schedule, and/or order reduction are not allowed within the 36-hour window prior to the departure time.
AM No Show - miss the bus in the morning If I or anyone in my party fail to arrive at my pickup location prior to the
Boarding time as indicated on my e boarding pass result me or anyone in my party to miss the bus, I shall receive NO REFUND or credit or voucher of any amount whatsoever.
PM No Show, miss the bus at the resort I/We acknowledge that I must return to the bus 15 minutes before the departure time, failure to do so may result in missing the bus and be stranded at the resort. In such event, I will be responsible for all the cost incurred, including but not limited to travel, food and lodging.
Passenger waits for the bus I/We acknowledge that arrival time each stop on the trip can be affected by traffic condition among other factors. I/we will arrive at the corresponding bus stop ahead of schedule wait for the bus. The bus does not wait for the passengers.
Delay, Turn Back and Diversion I/WE UNDERSTAND AND AGREE that the travel associated with trips and activities may at times occur during times of challenging driving conditions, difficulty to install snow chain and as such that significant travel delays and road closures can and do occur when traveling through mountainous areas, especially during the winter, and as such that reaching the intended destination or any destination ski area may be impossible to achieve. Similarly, unavoidable travel delays may result in late arrival at the resort, untimely returns to the originating point of a trip. I/WE KNOWINGLY ACCEPT THIS AND ALSO ACCEPT THAT NO REFUND FOR THE TRANSPORTATION CAN BE PROVIDED IN SUCH SITUATIONS. I/WE FURTHER UNDERSTAND AND AGREE that I/we will be transported to whatever destination is deemed by the bus driver, NAC Ski, LLC, and the bus tour leader the safest to travel to and also the most probably to carry out the intended activity. Upon arriving at any ski area once I/we accept in-kind items as I ordered, such as lift pass, rental coupon, lesson coupon, food coupon, etc., that I/we waive the opportunity for any refund of price difference. Any refund requests for the aforementioned items should a ski area be unable to provide the items or services purchased due to lift closures, limited lift operations, or other matters are outside the control of NAC Ski, LLC and must be addressed directly with the ski resort management.
Bus does not take anyone to hospital or wait for any individual NAC Ski, LLC is organizes and facilitates transportation between specifically stated points of origin (the pickup and drop-off locations) and a specific ski/snowboarding resort area. Except for unavoidable road closures and detours by authorized personnel such as CalTrans or the CHP, the bus shall follow the prearranged travel route without deviation or special consideration for any passenger(s). I/WE UNDERSTAND AND AGREE that in the event of any injury that if I/we are unable to make the return ride home or to any other destination, that the bus or other method of transportation chartered, organized, or facilitated by NAC Ski, LLC may depart from the ski resort without me/us and without any recourse from me/us. I/WE FURTHER UNDERSTAND AND AGREE that if I/WE are unable to make the return ride home that it is solely my/our responsibility to secure any and all necessary or prescribed care and to obtain my/our own transportation home or to another medical care facility where any and all related costs shall be borne by me/us.
Lost Items NAC Ski/we LLC cannot guarantee the security of items left on board any bus or vehicle during the day. Therefore regardless of any information that I/WE may receive to the contrary, including but not limited to comments made by bus drivers and/or bus tour leaders I/WE ASSUME FULL RESPONSIBILITY AND RISK FOR ANY PERSONAL ITEMS LEFT ON THE BUS AT ALL TIME. I/WE UNDERSTAND AND AGREE THAT NAC SKI, LLC IS NOT RESPONSIBLE OR LIABLE FOR ANY LOST, STOLEN, OR DAMAGED ITEMS. I/WE understand that skis, snowboards, boots, and equipment bags have similar appearances and that NAC Ski, LLC recommends that I/WE take care to identify my equipment and other personal items when extracting them from the bus and also that I/WE label my equipment to help prevent inadvertently taking someone else's property and visa-versa. I/WE UNDERSTAND AND AGREE any personal belongings left on the bus at the end of the trip are deemed lost and I/WE will not hold NAC SKI responsible for retrieving such items.
Parking I/WE understand the parking my vehicle at any pickup location involves risks including but not limited to vehicle being stolen, vandalized, broken-in or receiving citations. I/WE ASSUME FULL RESPONSIBILITY AND RISKS SHOULD SUCH EVENTS OCCUR.
Injury Outdoor alpine sports such as skiing and snowboarding in particular have known and unknown perils that include the potential for DEATH, SERIOUS INJURY, AND THE DAMAGE OF PERSONAL PROPERTY. I/WE understand the inherent dangers of extreme cold temperatures, skiing, snowboarding and all other outdoor alpine sports activities that include falls, collisions, and injuries due to the use of ski lifts, use of the ski area. I/WE and those from whom I/WE am booking/enrolling all confirm that I/we are undertaking the trip/activity of our own free will and further that we are in good physical condition and possess the dexterity to safely engage in the intended activity. I/we also confirm that I/we possess and will use the proper clothing, equipment, nutrition, and hydration to endure the inherent environmental and physical challenges. I/WE HEREBY ASSUME ANY AND ALL RISKS OF DEATH, INJURY, DAMAGE OR LOSS WHICH MAY RESULT THROUGH PARTICIPATING IN ANY AND ALL ACTIVITIES CONNECTED WITH OR ASSOCIATED WITH NAC SKI, LLC TRIPS AND THE CORRESPONDING PHYSICAL ACTIVITIES. In the event of any emergency, I/WE authorize NAC Ski, LLC and its bus tour leaders to interact with the ski resort medical personnel or a local hospital regarding any treatment deemed necessary for my/our immediate care and agree that I/WE will be responsible for payment of any and all medical services rendered.
Waive to Sue I/we further understand, acknowledge and accept all perils and risks stated and unstated, known and unknown, including those that may be the result of the negligence of NAC SKI/WE LLC, its assistants, volunteers, bus tour leaders, and employees. I/WE AGREE TO NOT SUE ANY RELEASED PARTY. I/WE INDEMNIFY AND HOLD HARMLESS AND WAIVE ALL RIGHTS TO SUE NAC SKI/WE LLC, its owners, assistants, volunteers, bus tour leaders, and employees for any claims, losses, or liabilities that I/we have expressly waived, released, and discharged herein.
On Board Behavior and Refusal of Service FURTHER, I/WE AGREE TO COMPLY WITH THE WRITTEN AND VERBAL INSTRUCTIONS GIVEN BY NAC SKI, LLC, ITS BUS TOUR LEADERS AND BUS DRIVERS. I/we also realize that if I/WE fail to exhibit appropriate behavior and conduct on board, become a nuisance, or otherwise endanger others, then at the discretion of the bus tour leader and/or bus driver, I/WE may be dismissed from the trip/activities without any refund whatsoever and be responsible for my/our own transportation home. Furthermore, participation in any future trip/activity may be prohibited. I/WE understand that if I/WE am not aboard the bus at the stated departure times, I/WE may be left behind and in such circumstances be fully responsible for my/our own transportation where any and all related costs shall be borne by me/us. I/WE also understand and agree to the stated refund policy clearly posted on the NAC Ski website should I/WE miss the trip. I/we understand that I/we will not intentionally damage nor destroy any property, and that any and all damages caused by me/us, whether intentional or accidental, shall be paid by me/us to owners of the damaged property.
BY PROCEEDING AND BOOKING THE TRIP(S) AND/OR ENROLLING IN AN ACTIVITY I/WE HEREBY AFFIRM THAT I/WE ARE 18 YEARS OF AGE OR OLDER, HAVE READ THIS DOCUMENT, AND UNDERSTAND AND AGREE TO ITS CONTENTS AND PROVISIONS.
ADDENDUM FOR TEENAGERS AND ADOLESCENT CHILDREN As the parent/guardian of the minor child(ren) being enrolled in the trip and/or activity organized and facilitated by NAC Ski, LLC. I/we acknowledge all of the preceding terms, provisions, warnings, recommendations, and stipulations including but not limited to the full release of any and all liability apply to my child(ren) as well as to myself and those for whom I/WE am booking the trip and/or activity. Further, my child(ren)and I/we agree that, as a condition of trip and/or activity participation, my/our child(ren) will at all times exhibit appropriate behavior and comply with the rules and instructions of the trip/activity leaders and/or bus drivers. I/we acknowledge that any trip staff shall have the authority to suspend or permanently dismiss my/our child(ren) from this and future trips for any of the following reasons. Should anyone's behavior result in dismissal from the trip/activity, then the parents will be notified to retrieve their child(ren). Furthermore I/WE UNDERSTAND that if my/our child(ren) is/are not aboard the bus at the planned and communicated departure time, then they will be left behind necessitating that I/we retrieve them or arrange alternate transportation home at my/our cost and without recourse.
Examples of unacceptable behavior and actions:
1. Smoking (of any sort) while onboard any bus or vehicle.
2. Possession of alcohol, illegal drug(s), or weapons.
3. Being a nuisance or committing disrespectful acts towards staff, volunteers, drivers, other passengers/participants.
4. Destruction or damage of property.
